- “‘Know Your Customer,’ or Agent, or Financial Institution, to Qualify for the Bankruptcy Code Safe Harbors,” by Ingrid Bagby, Kathryn Borgeson, Michele Maman, Eric Waxman and Marc Veilleux. In this article, the authors review a recent decision by the U.S. Court of Appeals for the Second Circuit and explain that parties must structure their transactions with precision and close adherence to statutory and case law requirements to gain protection of the safe harbors afforded under the Bankruptcy Code.
