The FTC and DOJ Seek Public Comment on Antitrust Guidance for U.S. and International Business Collaborations

Cadwalader counsel Bilal Sayyed recently authored an article for NYU’s Compliance & Enforcement blog analyzing the FTC and DOJ's request for public comment on new guidance for competitor collaborations.

Bilal explains that the agencies seek input on updating guidance after withdrawing the 2000 Competitor Collaboration Guidelines and other statements, citing their outdated methods and failure to reflect recent case law developments. He highlights opportunities to address collaborations in labor, health care, IP/technology markets, algorithmic pricing, data sharing, "roll ups," vertical integration and international export activities, with comments due by April 24, 2026.
