Cadwalader partner Douglas S. Mintz was quoted in a recent article by The Deal examining the continued rise of liability management exercises as companies face ongoing economic uncertainty and shifting market conditions.
Doug commented on the evolving dynamic between lenders in these transactions, noting that combative, lender-against-lender tactics have become less common. “When you add in the litigation cost of fighting with your fellow lenders, it turns out not to be a very positive experience,” he said.
Instead, Doug added, more collaborative and cooperative efforts are becoming increasingly popular as companies seek to restructure their capital efficiently without lengthy litigation battles.
