Takeaways From the Rovirosa Reversal

Cadwalader partner Martin Weinstein was featured in Anti-Corruption Report’s article, “Takeaways From the Rovirosa Reversal,” which examines Judge Kenneth Hoyt’s decision overturning the jury verdict in the FCPA prosecution of Ramon Rovirosa.

The article focuses on the Sixth Amendment, the admissibility of translated WhatsApp messages, and the government’s failure to produce underlying evidence.

Martin said, “It’s a very odd issue to base a motion on,” referring to Rovirosa’s post-trial challenge based on untranslated evidence and the translators’ absence from trial. He added that it “seems like a pretty far-fetched argument and one that the government could have cut off,” or cured, suggesting the issue should have been addressed before it reached the acquittal stage.

The article also notes Martin’s broader observations that the government’s failure to produce forensic images and screenshots was confusing, and that the case may reflect a broader discovery or trial-preparation misstep.
