Cadwalader partner Shai Schmidt commented in Bloomberg’s “The Brink” newsletter on the potential of rising Chapter 11 filings among AI-disrupted software companies.

“As AI disrupts the software industry, are debt restructurings more likely to take place in court or out of it?” Bloomberg asked Schmidt. “We’re starting to see the Chapter 11 option coming back into vogue,” he replied, noting that prior liability management exercises have left debt documents “too tight to do another one,” forcing in-court solutions with DIP loans to restructure leases and vendor claims alongside funded debt.
