Cadwalader’s leading energy team has wide-ranging and deep experience in complex energy regulatory, litigation, compliance, transactional, investigation, and enforcement defense matters. We provide counsel regarding the natural gas, oil, natural gas liquids, and power industries to marketers, producers, developers, industrial and commercial customers, trade associations, and financial institutions. We offer practical insights into the evolving business and legal issues affecting national and transnational energy markets.
Enforcement Defense: We regularly represent clients in enforcement matters before the Federal Energy Regulatory Commission (FERC) and the U.S. Commodity Futures Trading Commission (CFTC). We also advise on compliance and enforcement issues before the Federal Trade Commission (FTC) and before certain state public utility commissions (PUCs).
Regulation, Compliance & Administrative Litigation: We have extensive experience representing clients in regulatory matters before FERC, the CFTC, the U.S. Department of Energy (DOE), the FTC, and multiple state PUCs. We provide compliance advice and develop training programs for clients in the natural gas, oil, natural gas liquids, and power industries. In addition, we represent clients in rate, tariff, and administrative litigation at FERC.
Projects & Transactions: We advise clients on a wide variety of energy and commodity transactions, including mergers and asset dispositions, anchor agreements with pipelines and other infrastructure projects, and complex secondary market agreements for commodities and capacity. We have extensive experience in obtaining the regulatory approvals and performing the due diligence required in complex transactions, including securing FERC and DOE approvals for LNG terminals and other natural gas infrastructure.
